District Court of Appeals Says D.Cs. “Good Reason” Law Unconstitutional

Last month the SCOTUS declined to hear the Peruta v. San Diego case that we here in California have been patiently waiting to have it heard, adjudicated, and won. Afterall, we won that case once, only to see the unscrupulous Liberal gun grabbers do what they do best – lie, cheat and steal. They stole our victory by lieing about the facts and cheated by obtaining an illegal ‘en banc’ re-hearing the case that we won. It was illegal because it was requested by the State of California and they were not even a party in the suit.  They were successful at getting our win overturned.

But lo, what happened today may be a saving grace for us. A similar case coming out of Washington, D.C. was won by the Second Amendment Foundation. This case is actually stronger than the Peruta becuase it directly goes after the concept of the law. It is called Wrenn v. District of Columbia.

The U.S. Court of Appeals for the District of Columbia, actually issued a Permanent Injunction against the enforcement of the law as it is in Washington, D.C. That makes the law moot that requires applicants for a CCW in the District, to provide a “Good Reason” why the King should grant them access to their God given right to carry a gun outside of their home. Their law is Unconstitutional, plain and simple.

Good Reason is essentially the same as our Good Cause requirement. Judge Griffith wrote in his ruling that “The good-reason law is necessarily a total ban on most D.C. residents’ right to carry a gun in the face of ordinary self-defense needs…”

Striking it down will affect us, in time. The problem now is that the District could decide to appeal it to the Supreme Court which will take time. They could also request an ‘en banc’ hearing, similar that unscrupulous Kamala Harris did to our victory. She was Attorney General for the State of California at the time. In any event, it will take a ruling by the SCOTUS to finally have an effect on us. That will be what makes California’s law Unconstitutional. It will take some time for the legal wrangling to take its course. But we’re getting there.

Governor BrownOn this 4th of July weekend and Holiday, we here in the Socialist State we refer to as the People’s Republik of Kalifornistan, we get to also celebrate the loss of some more of our Freedom; Freedom that we thought was guaranteed by our Constitution and the Second Amendment. But when the people continue to vote Democrat they elect a Legislature that is 2 to 1 Democrat to Republican. As a result the Liberal Gun Grabbers are undeterred. The U. S. A. is Number ONE – in Gun Ownership

Proof Positive for the Liberal Left Antis that we need to Ban Guns.

Every time there is a horrific mass gun killing like we had in Orlando, the rabid left wing of our countries political governance, starts immediately crying for more gun control. They pull out their arsenal of agenda topics, their most favorite rant, Gun Control. House Sit-in (3)This time the Liberals in the House of Representatives weighed in, apparently thinking they were back in the ’60s, as they staged a meaningless and embarrassing “sit in” on the floor of the House.  They point to our sick, twisted obsession with personal gun possession in this country, our fanatical gun culture that is embarrassing to them when compared to their socialist European friends with highly superior gun control laws. We must be the most murdering country in the world, especially after Orlando.

So if we look at the statistics you would expect to find us at the top of the list. And yes, according to statistics for 2014, the United States tops the list in Glory. We are indeed ranked number 1 in the world with gun ownership at 90 guns per 100 people or .9 per person.  Foam FingerIf you had a random gathering of 1000 people, and you got an honest tally of how may guns they own among them, according to the statistics you would find 900 guns in the crowd. Amazing. The next country does not even come close with almost half as many guns at 58.2 guns per 100 people and that would be Serbia. Even Switzerland, where gun ownership almost required, is ranked fourth behind us with only 45.7 guns per 100 people.

There you have it. Something of which Rick Wyatt, Paige Wyatt and the entire crew at Gunsmoke Guns would be proud.  It is proof positive that the United States with their fanatical obsession with guns tops the list by far and we have far too many guns. This is surely evidence to the Progressive Left that they surely do live in the murder capital of the world with 90 guns per 100 residents. We must be the most murderous country in the world with those numbers.

So using Liberal gun thinking, all we have to do to prove the left wing Progressive case for banning guns is look at the Per Capita Intentional Homicide statistics for the murder rate in the world. Gun Control Laws Should Be Repealed

Gun & Constitution 2If you take a look at the more than 13,550 gun laws we have in the United States including federal, state and local laws, I defy you to find even one that has saved a life, prevented a crime, prevented a mass murder or political assassination. It can’t be done. Gun Control laws do not save lives or make people safe. To the contrary, they make people less safe by denying them the ability to defend themselves from predation.  So now they want what they like to call “Common Sense Gun Laws”.  There is no such thing.  They all make citizens less safe.

Most gun laws on the books today are there as a result of an emotional, irrational over reaction to some tragedy or sudden perceived threat.  None of the laws are based on Constitutional Law, or are consistent with overall dominant public opinion. Should We Just Give Up Our Rights? Surrender Our Guns?

Today, a week after the horrific slaughter in Orlando, the battle lines have clearly been drawn. Problem is, the Liberal Democrats seem to be better at staying focused on their agenda and hype. They seem to keep the drum beat for Gun Control banging in every direction you look.

The Liberals want to take the guns out of our hands and the Republicans believe we need to fight the war to defeat terrorism – “Militant Islamic Terrorism”.

It’s Time To Eliminate The Gun Control Laws: Yes, All Of Them

Behavioral laws require three components to be effective.  They must accurately describe an action that causes harm to others. They must propose a penalty that disincentivizes the activity. They must be enforceable.

Let’s consider the laws against murder. The harm done is obvious. The penalties range up to death. They can be enforced by an examination of the evidence during trial, and punishment.

How about “disturbing the peace?” If you plug in a Gibson ES35 guitar and a stack of Marshal and Hi-Watt amps at 2 a.m. and start playing Black Sabbath’s “Iron Man,” there’s a good chance your neighbors will complain.  If they do, we have a clear report of harm done (minor harm, but relevant), and can again have an examination, trial and punishment, probably a fine.

Of course, we could prevent some of those incidences by licensing guitars, having waiting periods on amplifiers, and requiring proof of need for any amp over 20 watts.

Gun Control – Do We Really Need It?

I couldn’t believe it the other day when someone whom I thought knew me, asked me, “So how do you feel about Gun Control?  Don’t you think we really need it?”  As if she didn’t know my answer to that!?  Looking back I now think she was just trying to get me going, but that’s OK too.  But as for Gun Control, let me put it this way.  Another great blog that I link to here, Extrano’s Alley, has this prominently displayed on the top of his front page and it pretty much sums it up.

There are more than 22,402 restrictive gun laws in force.  Of those, not even one has ever reduced crime. In fact, crime has increased after each of these laws, and the amount depends on the severity and level of enforcement of the law.

The fact is, (borrowing from the great movie with Humphrey Bogart, “Sierra Madre”) we don’t need no stinking badges – to carry our guns.  I added the last four words, but what I mean is we shouldn’t need no stinking permit to carry a gun, concealed or otherwise.  We shouldn’t have to show good cause to be able carry a gun, concealed or otherwise.  Let’s face it, criminals certainly don’t feel they need a permit to carry a gun when they are a committing a crime.  They’re already breaking the law.  Why should they worry about a stinking gun permit.

We already have the only permit we should ever need in the Second Amendment. Our Founding Fathers gave us the right to carry guns and they recognized that it was a right that should never be taken from us lest we see ourselves as subjects of a tyrannical government.  Our Constitution was written to restrict what Government can do – not restrict what citizens can do.

Just what part of “shall not be infringed” do you not understand?  And yet, every year, legislators devise some new way to infringe upon law abiding gun owners and restrict their gun right.  These same legislators took an oath to “support and defend the Constitution of the United States”.   But with every new Gun Control law they are further destroying the Constitution.  With every new Gun Control law they are violating that sacred oath and deliberately shifting the balance of power into THEIR hands and into the hands of the criminals.

That quote I placed above is probably a little old in that there are many more than 22,402 restrictive gun laws in these United States.  There are more laws every year, especially in California and New York – and Illinois, and Massachusetts, but I digress.  But not one of those Gun Control laws has ever stopped a murder, a burglary, armed robbery, car jacking, sexual assault – again I could go on.

Gun Control laws do absolutely no good to anyone but the criminals, because they actually make their job easier.  They only restrict law abiding citizens from being able to effectively defend themselves from others who have made crime their career choice.

New gun laws do accomplish one thing in that they secure the liberal legislators in their seats.  They appease their liberal base such that they will vote for them next time, confident that the same liberal hacks will continue to support ridiculous Gun Control laws.

I used to think that these new laws they write and pass must at least make them feel good in that they must feel that they have done something positive to protect society and keep them safe.  But any more I can’t believe that they could possibly continue to be that stupid.  When all of the evidence flies in the face of that notion, how can they really believe something so ridiculous?  Gun Control laws actually work to increase crime in every area or state they are tried.  Every large population center that has strict gun control laws, has violent crime that is out of control and on the rise every year.  It has gotten so bad that the crime statistics that they are reporting are deliberately cooked to try and show decreasing crime so they can continue support their absurd notions that Gun Control laws are working.

Gun Control laws are against the law in my opinion as every one of them goes against the Constitution of the United States and the Second Amendment.  Guns should always have a place in our Society or we will cease to be a free people.   The only laws we should even consider might be restricting those who have mental disabilities and violent criminals, although the latter does absolutely no good anyway.  But guns should never be in the hands of the mentally disturbed.  Although, there is another problem, how do you find those people before they commit some insane act?

Other than that, I believe the Gun Control laws we have now should be repealed.  Every law abiding citizen should be required to own a gun and know how to safely use it.  Crime in our country would amazingly become so much more infrequent that news bureaus would have to look other places for their news stories.  Of course they are doing a lot of that now already by making up new false issues in order to further liberal bias.  But that is another rant altogether that perhaps I will have to take on another day.

A society that does not trust its citizens with guns does not trust its citizens.   When citizens live in a society where only the police and military have guns, they are living in a police state  –  Anonymous
